Alabama Contested Divorce

If you are entering a contested divorce—if one spouse does not want the divorce or you and your spouse have serious disagreements about property division and child custody—you should expect the process to take at least 12 months to complete.

If you have children, you must attend a court-ordered parenting seminar. If one parent refuses to attend the seminar, that parent will not receive custody or visitation, or the divorce will be delayed, until he or she attends the class. The divorce will not be delayed because of refusal to attend unless the parent seeking the divorce is the non-compliant party.
